Litigation Counsel

Major Purpose of Job:

Litigation Counsel is responsible for assisting the Vice President, Head of Litigation in the management and

supervision of the FINRAs litigation program.  This includes overseeing the conduct, supervision, coordination, and evaluation of nationwide disciplinary proceedings filed before the Office of Hearing Officers and, if necessary, appealed to the National Adjudicatory Council.

Essential Job Functions:

Personally litigating or assisting in litigating select cases of varying degrees of complexity on an ad hoc basis

particularly in the district offices.  Assisting and advising approximately 120 litigation attorneys in both the

Departments headquarters in Washington, D.C. and 14 Wall St. and in the various District Offices across the country on litigation matters and strategies.  Ensuring consistency in the litigation program.  This includes extensive work with reviewing and drafting materials to be included on the Departments internal website for use by others within the Department.  Streamlining, and otherwise making more efficient, the litigation process.

Providing training on various aspects of litigation.

Education/Experience Requirements:

Law degree and seven years of securities litigation experience with demonstrated ability to try complex securities cases.  Knowledge of trial techniques, Federal Rules of Evidence, and Federal Rules of Civil Procedure is required.  Superior litigation, oral and written communication skills.  Admission to the bar of the highest court of the District of Columbia or state.  Candidates must also demonstrate experience to administer and manage complex litigation. Trial experience is essential.

Working Conditions:

The Enforcement Department is a professional environment in which quality legal work is expected.  Because the majority of disciplinary hearings that take place occur in FINRA District Offices, travel is required, and work outside of business hours expected.
